1. Agreement to Terms

Amplify Digital Media LLC provides video production and digital marketing services for businesses, including but not limited to video creation, editing, and marketing content development. In delivering these Services, we may use third-party platforms and tools, including GoHighLevel ("GHL") for client relationship management, scheduling, and communications, and artificial intelligence tools such as Kling and Claude to assist in content production and communication drafting. Final deliverables are reviewed by our team before being provided to clients.

3. User Responsibilities

By using our Site or Services, you agree to:

- Provide accurate, current, and complete information when requested, including contact information used for scheduling and communications.

- Use the Site and Services only for lawful purposes and in accordance with these Terms.

- Maintain the confidentiality of any account credentials or access provided to you in connection with the Services.

- Promptly notify us of any unauthorized use of your account or information.

- Provide any content, footage, branding materials, or approvals needed for us to complete your project in a timely manner.

By providing your mobile phone number to Amplify Digital Media LLC through our Site, a form, a verbal request, or another method, you consent to receive text messages (SMS) from us related to scheduling, appointment reminders, project updates, billing, customer service, and marketing communications about our video production and digital marketing services. Consent to receive text messages is not a condition of purchasing any goods or services.

Message Types. Message types may include: appointment and scheduling confirmations, project status updates, billing and invoice notifications, customer service responses, and occasional marketing messages about our services.

Message Frequency. Message frequency varies depending on your interactions with us and the status of your project (for example, you may receive more messages during active production and fewer once a project is complete).

Message & Data Rates. Message and data rates may apply, as determined by your mobile carrier. Standard carrier messaging charges apply to all SMS communications.

Opt-Out. You may opt out of receiving text messages at any time by replying "STOP" to any message you receive from us. After replying "STOP," you will receive a one-time confirmation message, and we will not send further SMS messages unless you opt back in. You may opt back in at any time by texting "START."

Carrier Disclaimer. Carriers are not liable for delayed or undelivered messages. Mobile carriers are not responsible for any content, delays, or failures related to our SMS communications.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Amplify Digital Media LLC or its licensors and is protected by intellectual property laws. Unless otherwise agreed in writing (such as in a signed client services agreement), final video deliverables are licensed or transferred to clients according to the terms of the applicable project agreement or invoice. We retain the right to use completed work for our own portfolio, marketing, and promotional purposes unless a client has requested and agreed otherwise in writing.

You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

7. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that the Services will meet your specific expectations or business outcomes. We do not guarantee the performance, accuracy, or availability of any third-party tools or platforms used in delivering the Services, including GoHighLevel, Kling, or Claude.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AMPLIFY DIGITAL MEDIA LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Smith County, Texas.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or for legal and regulatory reasons. The "Effective Date" above reflects the most recent revision. Continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.

If you provide your mobile phone number to us, you can expect to receive text messages from Amplify Digital Media LLC related to appointment and scheduling confirmations, project updates, billing and invoice notifications, customer service responses, and occasional marketing messages about our video production and digital marketing services.

Opt-Out & Support Mechanisms

After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
